Fellow attorneys:
Food trucks in my areas are increasingly popular, but we are having difficulties with fees/ permits, and especially with the collection of the sales taxes involved. One suggestion to me, as I draft a new Ordinance, is to require a new permit issued at City Hall each month, but only after the proof that sales tax has been collected and paid. This might be a burden to City Hall. Do any of you have suggestions? Do you have an Ordinance that I could examine?
How does your municipality handle these permits, and the collection of the sales tax?
Also, do you have guidelines for where they can/ can't park? How about competition with an existing storefront business? Distances in between?
All advice appreciated.
Thank you.
