A member is facing a request for concertgoers to be allowed to wear kirpans at an upcoming concert. For those not familiar, a kirpan, as I understand it, is a blade that is required as a part of a religious uniform for Sikhs. My instinct, as well as the requestor's, is that banning all blades, regardless of their purpose or religious affiliation is reasonable and would not run afoul of the First Amendment or any anti-discrimination laws. Prohibiting weapons at a concert is a compelling governmental interest. That said, if anyone has experience with this type of request, please email me at akarras@imla.org as the requestor would like to speak to you.

After learning a bit more, it sounds like this is an issue that does come up with at least some frequency and is more nuanced than I originally believed. For those that are curious, here’s an older settlement announcement from the EEOC regarding a workplace accommodation issue on the subject: https://www.eeoc.gov/newsroom/manorcare-health-services-settles-religious-discrimination-suit#:~:text=This%20is%20the%20second%20lawsuit,HCR%20ManorCare%2C%20Case%20No.). I had not initially understood that kirpans are dull blades, typically no sharper than a dinner knife. I do think that changes the analysis in some cases, but perhaps not others depending on where the individual is requesting the accommodation. I came across an interesting law review article on religious freedom and access to courthouses in the US and Canada as it relates to kirpans. The author argues that courts that allow scissors, forks, butter knives, pliers, and other pointed metal objects should also allow kirpans. I agree with that sentiment as it would undermine the public safety argument if you are allowing sharp objects for non-religious purposes, but denying the kirpan, which is undeniably integral to the individual’s religious beliefs. But I imagine a concert venue would also prohibit the attendees from bringing scissors and other pointed objects into the venue (but I’m less sure about forks and knives). At any rate, I wanted to share some additional thoughts with the group since I had originally chimed in with my reaction and believe the analysis is more nuanced given the nature of the kirpan.

After learning a bit more, it sounds like this is an issue that does come up with at least some frequency and is more nuanced than I originally believed. For those that are curious, here’s an older settlement announcement from the EEOC regarding a workplace accommodation issue on the subject: https://www.eeoc.gov/newsroom/manorcare-health-services-settles-religious-discrimination-suit#:~:text=This%20is%20the%20second%20lawsuit,HCR%20ManorCare%2C%20Case%20No.). I had not initially understood that kirpans are dull blades, typically no sharper than a dinner knife. I do think that changes the analysis in some cases, but perhaps not others depending on where the individual is requesting the accommodation. I came across an interesting law review article on religious freedom and access to courthouses in the US and Canada as it relates to kirpans. The author argues that courts that allow scissors, forks, butter knives, pliers, and other pointed metal objects should also allow kirpans. I agree with that sentiment as it would undermine the public safety argument if you are allowing sharp objects for non-religious purposes, but denying the kirpan, which is undeniably integral to the individual’s religious beliefs. But I imagine a concert venue would also prohibit the attendees from bringing scissors and other pointed objects into the venue (but I’m less sure about forks and knives). At any rate, I wanted to share some additional thoughts with the group since I had originally chimed in with my reaction and believe the analysis is more nuanced given the nature of the kirpan.

A member is facing a request for concertgoers to be allowed to wear kirpans at an upcoming concert. For those not familiar, a kirpan, as I understand it, is a blade that is required as a part of a religious uniform for Sikhs. My instinct, as well as the requestor’s, is that banning all blades, regardless of their purpose or religious affiliation is reasonable and would not run afoul of the First Amendment or any anti-discrimination laws. Prohibiting weapons at a concert is a compelling governmental interest.
