off-airport parking access fees

The Wichita Airport Authority is building its first parking garage, and the construction footprint has taken out of use a significant portion of the existing surface parking.  One off-airport operator has already taken this opportunity to start a parking/shuttle service.

The Authority wishes to impose a compensatory access fee on this off - airport operator.  Currently the Authority has no means to monitor individual shuttle trips, although that will be in place in approximately one year.

I would appreciate any sample contracts or applicable regulations/ordinances imposing access charges to off-airport businesses, and comments on the relative merits of per-trip and percentage-of-gross charges.

For both off-airport rental cars and off-airport parking companies we charge a 10% of gross revenues fee.  This is established by ordinance. For other types of shuttles and ground transportation we have a per trip fee.  I have attached our commercial vehicle lane agreement which includes a summary of the payment requirements and I have also included the relevant portion of our City ordinance below.  Please let me know if I can provide you with any further information.

Sec. 4-107. Classification of permits and fees.  The following shall be the classifications of ground transportation permits and the fees authorized by section 2-1http://library.municode.com/HTML/19970/level3/PTIICOOR_CH2AD_ARTIINGE.html#PTIICOOR_CH2AD_ARTIINGE_S2-1REUSFENOUSFE that shall be charged with respect to use of the commercial lane:

(1)          Off-airport RACs. A fee equal to ten percent of the RAC's gross revenues;

(2)          Off-airport parking operators. A fee equal to ten percent of the operator's gross revenues.

(3)          Hotel/motel courtesy vans. An annual fee for each hotel/motel courtesy van; provided, however, any hotel or motel may elect to have all hotel/motel courtesy vans owned or operated by it considered to be contract vans and pay a per-entry fee for each hotel/motel courtesy van into the commercial lane;

(4)          Commercial courier vehicle. A fee per entry into the commercial lane by each commercial courier vehicle; and

(5)          Contract vans, executive cars or limousines. A fee per entry of each contract van or limousine.
