Dear IMLA Immigration Working Group:

I am attaching a complaint filed by the federal government against the City of Rochester, NY based on the city's sanctuary policies.  The allegations in the complaint center on a 3/24 incident in which federal officers requested backup from Rochester police, who then responded to their request.  And then (again per the complaint) in the aftermath, the Mayor held a press conference criticizing the officers for assisting the federal officials and reaffirming the City's sanctuary policies.  The complaint also alleges that "upon information and belief, the officers involved were removed from road patrol and were required to receive additional training before being permitted to return to duty."

The complaint alleges that the city's sanctuary policies run afoul of 8 USC 1373 & 1644 "by forbidding Rochester police officers from communicating with ICE or CBP regarding a detainee, including the detainee's custody status, immigration status, release date, or the like."  The complaint alleges the city's policies violate the Supremacy Clause and are preempted and that they also discriminate against the federal government and unlawfully regulate the federal government.

The complaint seeks a judgement declaring the city's policies violate the Supremacy Clause and an injunction prohibiting the city from enforcing it.
