IMLA Federal Funding Information

Thank you for joining today's call on federal funding.  Here are a few items related to matters we discussed:

  1. Here is a link to the PI decision in the National Council of Nonprofits v. OMB case: https://democracyforward.org/wp-content/uploads/2025/02/PI-Order-NCN-et-al.pdf.  My reading of the order is that it could be interpreted more broadly than the PI in the Rhode Island case brought by the state AGs but it does not specifically say it applies to nonparties. Here's part of the order: "Defendants are enjoined from implementing, giving effect to, or reinstating under a different name the unilateral, non-individualized directives in OMB Memorandum M-25-13 with respect to the disbursement of Federal funds under all open awards"
  2. US DOT guidance re: Partially obligated grants (attached)
  3. FEMA Message re: Manual Reviews and Delays (attached)
  4. Here is an article about DHS sending letters out to local governments related to the FEMA Shelter and Services Program: https://www.tucsonsentinel.com/local/report/031225_pima_fema/feds-withhold-7m-pima-county-migrant-shelters-imply-local-officials-harboring-people-illegally/
  5. City of Evanston v. Barr decision on associational standing (attached).

And finally, we are going to discuss an internal mechanism to collect information from you all related to grant funding issues.  The idea floated was to create a centralized repository of information related to localities having funding challenges with particular grants.  The locality would be responsible for submitting the information to IMLA (we are working on the easiest way to do this administratively)  but the idea would be that they could remain anonymous in the database (though IMLA staff would know who provided the information and could potentially connect members that wanted to talk directly if given permission to do so).  As we need to research the administrative aspects of this, please stay tuned on this.
