Housing Code - Certificate of Occupancy

I represent a city that is exploring the possibility of implementing a more specific Housing Code particularly with Owner/Occupant Certificate of Occupancy.  The question that has been asked is whether it is possible to require an inspection upon a new occupant moving into an existing residence.  This city is dealing with an abundance of “slum lords” who are not maintaining minimum standards on their rent houses.  Does anybody have any suggestions or know of a city code which might address this issue.

I think this subject is addressed by the Oklahoma Protect Property Rights Act, there could be preemption issues.

Yes, we were on that track when the legislature in its infinite wisdom passed the slum lord act, aka protect property rights act.

  1. Can it be a simple as getting the new tenant's permission to do the inspection? Perhaps when they are requesting that the utilities be turned on.
    Assure them that you are not pursuing them, but are looking to be sure that the landlord is providing a minimally safe property.
  2. Consider placing the inspection as a requirement for all new utility connections as a part of the utility contract
  3. If there are prior prosecutions in municipal court, discuss with your judge whether he/she will make a court authorized inspection a part of future convictions.
