In connection with IMLA's amicus brief in the Plumhoff v. Rickard case pending in the Supreme Court, it would be helpful if we could identify excellent statements of test for qualified immunity in deadly force cases in the various circuits which we could urge the Supreme Court to "officially" adopt or endorse. It would be particularly helpful to see cases that discuss how to deal with situations where reasonable minds could differ whether deadly force was reasonable. I would appreciate it if anyone could send along citations for those decisions, to peter.keith@sfgov.orgmailto:peter.keith@sfgov.org.
