Dear IMLA Immigration Working Group:

I am passing along a few items:

  1. White House Memorandum Dated 4/15 entitled "Preventing Illegal Aliens from Obtaining Social Security Act Benefits"  - https://www.whitehouse.gov/presidential-actions/2025/04/preventing-illegal-aliens-from-obtaining-social-security-act-benefits/.  The memo directs agency heads "to the extent appropriate and consistent with law, prioritizing civil or administrative enforcement actions against States, localities, or other similar grantees or subgrantees that do not take adequate measures to verify eligibility, stop payments to deceased or otherwise ineligible payees, or otherwise prevent ineligible aliens from receiving funds from Social Security Act programs.

  2. A DHS press release about a subpoena we discussed this week on our call that was sent to LA County's Department of Public Social Services regarding the California Assistance Program for Immigrants (CAPI): https://www.dhs.gov/news/2025/05/12/department-homeland-security-investigates-state-california-providing-federal.  The press release details the information DHS is seeking from the county.

  3. A LA Times article that discusses the CAPI program and the DHS subpoena: https://www.latimes.com/world-nation/story/2025-05-12/trump-dhs-investigates-la-county-capi-program.  While I am not familiar with CAPI, my understanding is that this is a program that benefits immigrants who are in the country lawfully.

  4. Here is a news article from March about an ACLU lawsuit against a Minnesota county for complying with an ICE detainer: https://www.cbsnews.com/minnesota/news/carver-county-sheriffs-office-ice-lawsuit-aclu/.  The article links to a Minnesota AG opinion indicating that Minnesota law prohibits state and local law enforcement agencies from holding someone based on an immigration detainer if the person would otherwise be released from custody.  https://www.ag.state.mn.us/Office/Communications/2025/02/06_ImmigrationDetainer.asp.  This is a good reminder to be sure you are up on your state law considerations regarding these detainer issues.
