Request for information regarding Sanctuary Cities-Counties

I received this request from one of our friends with another national group and I would welcome your thoughts which I would pass along:

In response to request from Rep. Culberson, Office of Justice Programs has put out new guidance for Byrne Justice Assistance Grant and State Criminal Alien Assistance programs on compliance with § 1373.  Am working with counterparts in state and local government and law enforcement organizations, and some immigration advocacy groups, to determine seriousness of this guidance.  In addition there is a USDOJ OIG report that was just released.
One school of thought is that since § 1373 doesn't apply to policies regarding asking immigration status and only to those which prohibit sharing information, and much of that information automatically gets shared when a person is arrested and processed, this may not be a huge issue that will jeopardized funding.  It is cause for concern, however.
Any thoughts you or your folks have on this would be much appreciated.
