Had a weird question from one of my small municipalities. I was asked if the town could require larger businesses (e.g. convenient stores) to have a trash compactor. Apparently there are businesses that are allowing trash and debri to get blown around and litter the streets. My initial concern is that there may be a taking issue if the town required such an undertaking, although, admittedly, I know very little about trash compactors. Aside from advising them to pursue nuisance actions or write citations, does anyone have any advice on this matter? Would it be permissible? Phillip N. Morton, J.D. P.O.
