Thank you for your response to my posting on the list.  I posted it because I
believe that any provider of any product especially one that costs over
$350,000, has a duty to be courteous and caring for their customers and not
to insult them, as your posting would seem to indicate you are accustomed to
doing. My contract was written by Rueben Trane and written as he chose to
write it, which is to say that he listed each individual item to be
fabricated into the boat.  There, in fact, were a total of 66 change orders
written because the factory insisted on a change order for each and every
change, no matter how trivial.  Also, my contract gave me the right to
provide products for the boat, such as electronics, if I choose, and in many
cases I did. This generated a change order.  When I purchased hull #2 the
company had not sold a boat for nearly one year and was very eager to sell
one.  In working with Reuben, It was agreed that we would create a more
customized boat than hull #1 and as work progressed, many changes were made
which eventually lead the company to arrive at the standardized boat which
they are now producing.

I noticed on the same digest as your posting, that Terry Smith of Houston,
Texas saw fit to jump in and support the company.  My hope for them is that
they continue to enjoy the same experience throughout the continued
manufacture of their boat and the delivery of it.  I recall their first
postings to the list when I was lurking.  My boat was mentioned several times
by them as being one that was being built with all bells and whistles and was
therefore behind in production.  This was a line being promulgated by Rueben
Trane as a way to explain his way out of the problem of my boat not
progressing at a reasonable rate.  I called him on the fact that he was not
telling his customers the truth and he replied in a way that indicated that
he didn't want to embarrass himself by telling them the real reason the boat
was stalled in it's construction.

Two more points, and I am gone. My contract stipulated in part that I would
be given "an estimate of any additional building time requirements" on any
change order. I was never advised that I was delaying the construction
because of change orders. Secondly, I see Mr. Ficketts viscous and blatant
attempt to intimidate me to be his method to effectively negate the warranty
problems.  So far he has succeeded.
