Yesterday, the 6th Circuit decided a case involving a large judgment against police officers who were sued by a man who claimed to have been unlawfully convicted based on the police officers' unconstitutional conduct. The officers were denied qualified immunity when the court denied their summary judgment motion. The officers failed to timely appeal and the case went to trial. The officers lost but they did not preserve the qualified immunity defense by raising it in a Rule 50 post trial motion. A link to the case follows:
