Public Works Authority Trust. Trust was originally created in 1966. Trust
needs to be updated particularly in regard to competitive bidding
requirements. I cannot find law saying the trust can be amended and I
cannot find law saying it cannot. Trust does have indebtedness for water
plant. As long as do not terminate the trust can the current town board of
Trustees amend by canceling all provisions and restating the trust?

A trust indenture can be amended- you will need to have the trustor approve (if they are still around) as well as the trustees of the public trust and the governing body of beneficiary. The holder of the indebtedness may need to approve as well-sometimes there are covenants in the note or bond terms addressing that- so long as it does not affect the debt or the lender's security interest, they will usually approve, in my experience. As I recall, we also passed a resolution of the trust authorizing the amendment and the execution thereof and the governing body of the town passed an ordinance authorizing the amendment. Luckily, in my experience the trustors of the trust have been available to approve for any trust amendments, but if not, you may need to file a trust action to have the district court approve the amendment- perhaps someone else has dealt with that as I have not. I can send you what I have if you need it.

The trust indentures I’ve seen include a provision stating how they can be amended. Does yours not?
