Rescinding a Resolution where Gov Body was Misled

All,

Here is something we are researching and I thought I would reach out to the group.

We have an Urban Renewal Authority who has to approve any urban renewal related agenda item that comes before the City Council. In 2022, there was a series of three resolutions that were passed that were presented with misleading information that would not have been passed had all of the information been presented (that person is no longer here).

The Mayor and governing body now want to pass a resolution to rescind those three resolutions, but since it’s an action that involves the urban renewal authority, we need to know if they have to approve it. I’m of the mind to have the Mayor continue to appoint his folks who will be able to approve it, but he wants to rescind it because we were misled and says that they should be able to do it without their approval because of the misleading information.

I just thought I’d reach out to get some thoughts.

Thanks,

John R. Andrew, J.D., M.P.A.
