A member alerted me to the below and I wanted to be sure to pass this along given the tight deadline. Bird Global Inc. ("Bird")-the rideshare electric scooter company-filed for bankruptcy on December 20, 2023, in the United States Bankruptcy Court in the Southern District of Florida under case number 23-20514-CLC. In those proceedings, the court entered the attached Confirmation Order and Plan. While there is much to read in these documents, we are writing specifically with respect to the Tort Claims Trust established by the Plan. In short, the Tort Claims Trust was established to resolve claims arising out of accidents involving Bird scooters, for which Bird may be directly liable or liable through indemnification, that occurred on or before March 22, 2024. There are some protections available by participating in the Tort Claims Trust for entities that have outstanding tort claims involving the Bird scooters, but there is a very quick participation deadline. We are writing to let other municipalities know about the existence of this Tort Claims Trust but also to inform those municipalities that the trust may yet be dissolved, and all protections arising out of the trust will disappear unless it is fully funded by March 5, 2025.
