Really two options. If it's a one-off situation and is not something
directly addressed by the CBA, then if it's something that has to be
bargained (i.e. terms and conditions of employment and not within the
purview of a management right to take unilateral action), then an MOU is a
good way to document the result of that bargain. Whether it needs to be
added to the CBA really turns on whether it's the kind of unique, one-off
situation that isn't likely to recur and/or the resolution is or is not
intended to set a precedent going forward.
If it's something addressed by the CBA and both sides believe the CBA needs
to be amended, then as the parties to the contract, the City and Union
could agree to amend their contract. Whether you style that as an MOU (to
document the amendment) or as "Amendment #1 to the FY 22-23 CBA" is
really irrelevant - what's relevant is that the parties to the contract
agreed in writing to the amendment.
