IMLA Federal Funding Update

Good afternoon:

Here are a few federal funding updates:

  1. The defendants filed a motion to dismiss in Sustainability Institute v. Trump, which is attached. (You will recall that the court recently ruled on the merits in favor of the localities and nonprofits on 32 out of 38 grants).  The defendants argue that the plaintiffs failed to exhaust administrative remedies as to their USDA grants (the 6 that the court did not enter judgment on the merits on) and that the court lacks jurisdiction as to all other claims (though the court has already entered judgment on the merits for the plaintiffs on these other 32 grants).  While the court has already rejected the defendants' Tucker Act arguments, the motion is in many ways repackaging the prior jurisdiction argument.  (The thinking is that this may be in an attempt to preserve the issue on appeal though it's a bit bizarre given the court already ruled on the jurisdictional issue).

  2. The court held a PI hearing on 5/30 in San Francisco Unified School District v. AmeriCorps.  There is not yet an order on that but I'll keep an eye out for it.

  3. The TRO in King County v. Turner is set to expire tomorrow.  I will be watching the docket to see if a PI is issued though I'll be traveling tomorrow for business so may not see it right away.

  4. I'm also keeping an eye out for the updated sanctuary jurisdiction list (which I assume is coming).
