In watching the news I've seen various approaches to releasing police videos. In our Model Body Cameral Legislation we include some provisions regarding the release of the videos and I thought it might be helpful to understand what policy other municipalities follow with regard to releasing evidence, such as a video, of alleged police misconduct under circumstances where an investigation (either criminal or administrative) and/or civil litigation is pending.
I have seen media reports to the effect that municipalities have differing approaches to the issue. It has been reported, for example, that in Cincinnati such evidence will be released within 24 hours unless there exist "compelling investigatory reasons" to hold it longer. I'd be curious to know if that's an accurate statement of the Cincinnati policy, and what policy other municipalities follow.
