Fellow Attorneys: Does anyone have a form for a Resolution calling for Special Election to fill vacancy due to failure to appoint in 60 days?Council - Manager form of government. And... Can Council pass the Resolution calling for the Special Election a few days prior to the passage of 60 days from resignation?(Item a. on my proposed Agenda is "to appoint".) (Item b on my proposed Agenda is "to pass Resolution calling for Special Election for failure to appoint") The dilemma is: 60 days will not have passed from date of resignation until May 9; My Regular Council Meeting is May 1; My Council does not want to have to have another Special Meeting within that 8 day time frame, to pass the election Resolution .If they fail to appoint on Item a, they want to go ahead and pass the Resolution for Special Election on Item b.
