DEQ usually will work with a municipality on payment of fines. It would be worth opening up a dialogue with them on rectifying the issue before the fines are collected. Many times the available revenue is best applied toward infrastructure improvements to address the issues. Hopefully, DEQ would suspend some of the fines.

It has been my experience that ODEQ is more interested in compliance than collecting fines. Unless your city believes the Consent Order is unjust, working with ODEQ to map out a plan to achieve compliance is often incentive for ODEQ to waive, reduce, or suspend fines. This approach may give your city more time to plan for the costs necessary to achieve compliance. If you have already tried this approach, then a loan through the public trust, as David suggests, is a good option provided you can find a willing lender. Hope this helps.

Colleagues:

How would a municipality pay for DEQ ordered clean up on short notice? There is not enough time for regular notice or a hearing because of the time frame to pay the fines. And the municipality does not have an operating reserve.
