Below is the agenda for the call. While the agenda may be self-explanatory, I wanted to take a moment to explain our idea of how this call and future calls will go. After the necessary introductions, we'd like to focus on one particular "hot topic" area of municipal litigation. We'd then have a brief presentation on that topic by a member of our group (or someone outside the group if necessary) to facilitate the discussion - 10-minutes max. Note: this presentation will not be an in-depth discussion of the jurisprudence, rather it'll be about the practical application of a topic/case we all know very well...or, well enough. Following that discussion, we'll open it up to any other "hot topics" anyone would like to discuss. Of course, if there is other business to attend to, we can deal with that, too.
This month we'd like to discuss the practical application of Reed v. Town of Gilbert. While we've all learned quite a bit about the opinion, our upcoming call will focus on what has happened around the country following the decision. Specifically, we'll be focusing on 1) how cities are changing (or should change) their ordinances to avoid a Reed problem and 2) what litigation strategies have been employed when faced with a Reed lawsuit. Fortunately, there is an attorney in our office who has been both modifying ordinances to comply with Reed and has also been analyzing Reed litigation.

I'm not sure if you'll get to Mullenix v. Luna, but it was a very good decision for those defending the police. Also, note that the Court also granted cert and vacated decision in Pickens v. Aldaba, 777 F.3d 1148 (10th Cir. 2015), remanding it for further consideration in light of Mullenix. In Pickens, court denied qualified immunity to officers who used taser on mentally ill individual to keep him from leaving hospital and hurting himself, etc... There was a lengthy dissent in the circuit court.
