Hiring of Librarian

Good morning everyone:

One of my council-manager cities is looking to hiring a new library director. The Library Board has made its recommendation per city code and state statute, but the question has now become who actually makes the hiring decision. The state statute (11 OS § 31-104https://www.oscn.net/applications/oscn/DeliverDocument.asp?CiteID=76227) states that the “board may appoint a suitable librarian and remove the librarian, subject to approval of the municipal governing body.” The City Code says something fairly similar, but I know it was drafted before the city became a council-manager city. The question is in a council-manager city, should the manager make that hiring decision or should it still default to the council like it appears that statutes say?

I feel like that answer is probably pretty clear, but anytime something potentially bucks the trend of “manager is in charge of personnel decisions” I always get a little apprehensive about pushing forward without looking for some other thoughts on the subject.

I appreciate any input anyone can give.
