FAA - Flight paths - Arbitrary and capricious

Today, the DC Circuit Court of Appeals gave a major victory to the City of Phoenix in its suit against the FAA for changing flight patterns at its airport concluding the FAA had acted arbitrarily and capriciously.  The court recounts how the FAA dealt with low level employees and did not reveal their plans to airport management until the eve of the changed flight patterns and then refused to delay implementation.  Clearly, the majority of the panel felt the FAA could have been more cognizant of the local government's commitment to its community.  Congratulations to John Putnam and Peter Kirsch, Kaplan, Kirsch Rockwell and Brad Holm City Attorney.
