In Charlotte County we do not obtain settlement authorization in advance. All of our settlement negotiations are always "pending approval by the Board". We then bring any proposed settlement and settlement agreement to the Board in an open public meeting with our recommendation to approve.

For Prince George's County,  the general answer is no.  However, based on the nature of the matter, we may confer with our County Council prior to finalizing a settlement.  We also give periodic litigation updates to Council.

We are not required to seek pre-approval for settlements.  After we have reached a "recommended" settlement figure in our cases, we present the recommended settlement to our Board (if $100K or more) or to our Claims Committee (if under $100K).

We have a member facing possible state legislation that would require the city to obtain settlement approval from its city council prior to making a settlement offer above 1 million. The member has asked if there are other IMLA members with this problem.  Specifically, our member asks:

1. Is your city or county required to obtain pre-approval from its legislative body before making a settlement offer and/or before finalizing a proposed settlement.
2. If yes, does your city or county pay settlements through a self-insurance pooling mechanism in which a Board of Directors also reviews and approves the settlement?
