As an aside, IMLA is currently participating as an amicus in a Fifth Circuit case in support of the City of Dallas in a challenge to its ordinance where the plaintiffs are arguing that the secondary effects doctrine was abrogated by Reed v. Town of Gilbert. The district court punted on this questions and found the ordinance would not survive strict or intermediate scrutiny. See Ass'n of Club Executives of Dallas, Inc. v. City of Dallas, Texas, No. 3:22-CV-00177-M, 2022 WL 1642470 (N.D. Tex. May 24, 2022).
