Experience with Trying a Complex FHA Case

A member is going to trial on a Fair Housing Act (FHA) case that is unique in their jurisdiction and perhaps the country and they would like to speak with anyone with relevant experience in this area.  I am providing a general sketch of the issues below.   • The case involves a FHA challenge to the City's community preference policy, which allocates priority for 50% of affordable housing units in a development to residents of the community district in which the development is located (community districts or CDs are physical geographies that typically constitute 2 neighborhoods)

  • Plaintiffs are two African-American women who claim that the policy perpetuates segregation and was passed, expanded and maintained to intentionally discriminate (by being responsive to people that want to avoid racial change of neighborhoods/maintain racial segregation)

  • The City asserts that the policy helps mitigate displacement and is responsive to the fear of displacement, which in turn helps overcome opposition to affordable housing (usually from low-income communities)

  • The member is looking to speak with local government lawyers who may have taken a similar or otherwise complex FHA case to trial
