IMLA Federal Action Updates

Good afternoon:

Here are a few updates.

  1. I have created a lawsuit tracker that I will endeavor to keep up to date on our website.  While there are other trackers out there for legal actions related to federal executive action, these are the cases I think are most relevant to local governments.  You must be logged in to your IMLA account to access it as it is a member resource.  You can view it here: https://imla.org/wp-content/uploads/2025/06/Legal-Action-Tracker-6-13-258.pdf.  Let me know if you think there are any other cases we want to track or any information that appears to need to be updated.

  2. An update on Middle East Broadcasting Networks v. United States / Radio Free Asia v. United States.  These were the cases that involved a 2-1 panel of the DC Circuit staying a preliminary injunction by the district court based on the panel's views that the federal government was likely to succeed on its Tucker Act / jurisdictional arguments.  Recall that after that, the en banc D.C. Circuit Court stayed that stay.  Then, on 5/28, the en banc court voted in favor of en banc reconsideration and denied the government's motion for stay pending appeal.  Briefing has been set and it looks like Appellees' Brief is due 07/15/2025. Appellants' Reply Brief due 07/31/2025.  I'm not sure how quickly we'll get argument in the case or a decision, but considering the recurrence of the Tucker Act issues, we will want to watch this.

  3. In California v. DOT, the court has scheduled the PI hearing for 6/18 9 am eastern.  The hearing will be available on the court's YouTube Channel.  Details will be available on the Court's website the day of the hearing (I am not seeing it listed yet but presumably they'll add it soon).  The court has also made the Illinois v. FEMA case available at this same link.  (That hearing is scheduled for 6/17 at 9 am eastern). Here is the link: https://www.rid.uscourts.gov/public-access-telephonic-and-video-hearings
