Greetings:
Our City Clerk Treasurer's will be on the Agenda. The City Clerk Treasurer is a salaried, elected official with salary set by ordinance. and consideration, discussion and possible action will be as to salary amount only. Consideration, discussion and possible action will not be as "the employment, hiring, appointment, promotion, demotion, disciplining or resignation of any individual salaried public officer or employee." Therefore, I do not believe executive session is authorized under Title 25 O.S. Sec. 307(B)(1).
Agreement? Disagreement?
Thank you.
I am familiar with the apparent contradiction of 1978 OK AG 201 and 1996 OK AG 40, with the latter opinion being that "[u]nder the provisions of 25 O.S. Supp.1995, § 307(B)(1), which permit the holding of an executive session for the purpose of '[d]iscussing the employment, hiring, appointment, promotion, demotion, disciplining, or resignation of any individual salaried public officer or employee,' a public body, such as a board of education, may go into executive session for the purpose of discussing the salary of an individual salaried public officer or employee."
