Last week, I asked if anyone knows of an ordinance that requires businesses
to maintain fire or smoke detection systems that are monitored 24/7. I've
drafted such an ordinance for the council's consideration.
When certain conditions exist, the ordinance requires compliance for new
construction, remodeled spaces, and upon change of ownership or primary use.
It also requires existing businesses to bring their buildings into
compliance within 6 months of the passage of the ordinance.
Do you have any concerns that the requirement that existing businesses
comply within 6 months is not legally enforceable?
(I believe there are likely significant issues with enforcement from a
practical standpoint. That's not what I'm concerned about here, though.)
