With the United States Supreme Court ruling in McGirt v. Oklahoma, 2020 WL 3848063 decided July 9, 2020, many cities and towns in Oklahoma are contemplating the impact of this ruling on them. The OAMA website, Raising the Bar (www.okmunicipalattorneys.orghttp://www.okmunicipalattorneys.org) has started a collection of resources for review and reference. There have been a number of officials and organizations working to provide clarity to this area of the law. On the OAMA website you will find the McGirt Opinion, FAQs from the Attorney General, advice from the AG re criminal matters, advice from the Oklahoma Municipal League, and a PowerPoint presentation from the Assistant US Attorney for the Northern District of Oklahoma that provides additional perspective. In addition, the Congressional Delegation for the state of Oklahoma has issued a joint statement regarding a framework for legislative efforts that is linked to the AG FAQs page. OAMA has also been working to coordinate with these groups. OAMA is also looking for municipal attorneys across the state who are willing to lend their expertise in this area as we work to identify specific areas of concern from Oklahoma cities and towns that should be considered and/or addressed.
