Municipality needs an easement for sewer line across property. According to
record, property is owned by H&W, JTWROS.
H&W are both deceased for several years. Their sole heir is Daughter. No
probate has been filed. Daughter is not willing to grant easement
(municipality offered to pay for probate or Determination of Heirship/QT). D
doesn't seem to be against easement, necessarily. She just doesn't want to
mess with it right now because she has more important matters on which she
needs to focus.
The municipality is facing several different deadlines & must get this
moving. How can the municipality proceed with exercising imminent domain &
obtaining the easement via condemnation under these circumstances?
