In that EO, the head of every agency was directed to include a term requiring any party to a contract or grant with the federal government certify that it does not "operate any programs promoting DEI that violate any applicable Federal anti-discrimination laws" and the grantee must agree that its "compliance in all respects with all applicable Federal anti-discrimination laws is material to the government's payment decision" for the purposes of the False Claims Act.
