Donation of a Building to the Drug Task Force

Greetings All:

I am the City Attorney for the City of Altus.  A District Drug Task Force exists ... primarily active in SW OK ... statewide jurisdiction ... most financing via JAG grant which must be renewed annually.  The APD/City and the DA/DTF have an interlocal agreement that is typically renewed annually.  A question has been presented as to whether the City may donate an old, unused building to the DTF.  I do not think that the DA's office or the DTF can possess title to the property.  Could the property be donated to the County with the restriction that ownership reverts to the City if the building ceases to be utilized by the DTF?  In the alternative, what about a lease-purchase agreement on very favorable terms to the County, with the aforementioned restriction?

I can, and will, show benefit to the municipal community both in recitals and in the open meeting.

Why not declare the old building surplus, sell it to the County cheaply or donate it to them and let them deal with maintenance, etc. going forward.  The two cities I deal with have old buildings and have tried to get them off their books but it can be difficult.  This situation is much better because of the public good it will do with the Drug Task Force getting they usage.

I am the City Attorney for the City of Altus.  A District Drug Task Force exists … primarily active in SW OK … statewide jurisdiction … most financing via JAG grant which must be renewed annually.  The APD/City and the DA/DTF have an interlocal agreement that is typically renewed annually.  A question has been presented as to whether the City may donate an old, unused building to the DTF.  I do not think that the DA’s office or the DTF can possess title to the property.  Could the property be donated to the County with the restriction that ownership reverts to the City if the building ceases to be utilized by the DTF?  In the alternative, what about a lease-purchase agreement on very favorable terms to the County, with the aforementioned restriction?

I can, and will, show benefit to the municipal community both in recitals and in the open meeting.

I am the City Attorney for the City of Altus.  A District Drug Task Force exists … primarily active in SW OK … statewide jurisdiction … most financing via JAG grant which must be renewed annually.  The APD/City and the DA/DTF have an interlocal agreement that is typically renewed annually.  A question has been presented as to whether the City may donate an old, unused building to the DTF.  I do not think that the DA’s office or the DTF can possess title to the property.  Could the property be donated to the County with the restriction that ownership reverts to the City if the building ceases to be utilized by the DTF?  In the alternative, what about a lease-purchase agreement on very favorable terms to the County, with the aforementioned restriction?

I can, and will, show benefit to the municipal community both in recitals and in the open meeting.

A District Drug Task Force exists … primarily active in SW OK … statewide jurisdiction … most financing via JAG grant which must be renewed annually. The APD/City and the DA/DTF have an interlocal agreement that is typically renewed annually. A question has been presented as to whether the City may donate an old, unused building to the DTF. I do not think that the DA’s office or the DTF can possess title to the property. Could the property be donated to the County with the restriction that ownership reverts to the City if the building ceases to be utilized by the DTF? In the alternative, what about a lease-purchase agreement on very favorable terms to the County, with the aforementioned restriction? I can, and will, show benefit to the municipal community both in recitals and in the open meeting. Thank you. Another approach might be a joint governmental agreement for use of the building as authorized under 74 OK STAT Section
The statute is copied below.  this is different from an intelocal agreement and no approval of attorney general is required for this type of agreement.

I am the City Attorney for the City of Altus.  A District Drug Task Force exists … primarily active in SW OK … statewide jurisdiction … most financing via JAG grant which must be renewed annually.  The APD/City and the DA/DTF have an interlocal agreement that is typically renewed annually.  A question has been presented as to whether the City may donate an old, unused building to the DTF.  I do not think that the DA’s office or the DTF can possess title to the property.  Could the property be donated to the County with the restriction that ownership reverts to the City if the building ceases to be utilized by the DTF?  In the alternative, what about a lease-purchase agreement on very favorable terms to the County, with the aforementioned restriction?

I can, and will, show benefit to the municipal community both in recitals and in the open meeting.
