We have had a rash of irate residents/customers who have been highly confrontational with our PWA staff because of recent state mandated increases in our water and sewer rates. The city manager installed a security camera with recording capability in the lobby of the city hall adjacent to the window where residents come to pay bills and interact with city employees. The Council wants to keep the camera and have the staff maintain the records of the recordings. Based on my review of the Oklahoma regulations, I do not believe that the lobby of the city hall constitutes a location where one should have a reasonable expectation of privacy and, therefore, the camera and recordings do not require permission of those residents or customers whose interactions may be captured by the system. The city manager has now removed the camera because he says his legal research (he is not a lawyer) causes him to believe that the cameras are illegal. That is not my interpretation of the information I have reviewed, but I have to assume this is an issue that has been dealt with by other municipalities and would appreciate any insight that you have on these issues.
