In Baltimore we hire outside counsel to represent virtually all officers charged with excess force (except for those criminally charged and a few others) and we ourselves represent Police Dept) and City and their senior officials.

We have historically represented both the City and officers with one outside counsel. However, we have had a few cases, where the officer was disciplined or fired and needed to secure the officer his separate attorney.

We usually represent the officer unless there is some conflict that is apparent at the beginning of the case.  If, during the course of discovery, a conflict arises, we withdraw and provide outside counsel at the City's expense.  We also provide a letter at the outset outlining the potential for a conflict and advising that we may withdraw if a conflict arises.

We usually represent the officer unless there is some conflict that is apparent at the beginning of the case. If, during the course of discovery, a conflict arises, we withdraw and provide outside counsel at the City's expense. We also provide a letter at the outset outlining the potential for a conflict and advising that we may withdraw if a conflict arises. We use outside counsel to represent the City and the officer.  However, in two of our officer involved shootings resulting in fatalities we hired one law firm to represent the officer and one law firm to represent the City on the Monell claim.

In Montgomery County, Maryland, we generally represent both the officer and the County unless we determine there is a conflict at the outset with the position taken by officer vs County ( or it could come up as the case progresses but we have not really had that) Then we would get outside counsel at our cost. If there is a real issue of punitive damages, we advise officer he can also get own counsel since County not liable for punitives. We discuss this all with officer at outset of case.

In the City of Anaheim, California, we also, in almost all cases, represent both the City and the police officers with a signed conflict waiver from the officers at the outset.

Never had a problem in over 20 years.
