We have historically represented both the City and officers with one outside counsel. However, we have had a few cases, where the officer was disciplined or fired and needed to secure the officer his separate attorney.

We usually represent the officer unless there is some conflict that is apparent at the beginning of the case.  If, during the course of discovery, a conflict arises, we withdraw and provide outside counsel at the City's expense.  We also provide a letter at the outset outlining the potential for a conflict and advising that we may withdraw if a conflict arises.

We use outside counsel to represent the City and the officer.  However, in two of our officer involved shootings resulting in fatalities we hired one law firm to represent the officer and one law firm to represent the City on the Monell claim.

If there is a real issue of punitive damages, we advise officer he can also get own counsel since County not liable for punitives. We discuss this all with officer at outset of case.
