Yesterday, the 9th Circuit on several motions for review of an opinion issued earlier this year reconsidered and essentially reaffirmed a decision that the City of Los Angeles could include within its contract with vendors at its airport (LAX) a "labor peace agreement". And, that in doing so it acted as a proprietor rather than a regulator thus avoiding preemption language in the NLRA, the RLA and ADA. In this new opinion, the court affirmed the District Court's decision to deny leave to amend.
