Does anyone have a "mini" mutual aid/cross-deputization agreement between a city and a tribe whereby the tribal officers assist the city's officers throughout the City limits? We have a good relationship with the Iowa Tribe in Perkins. The City Manager/Police Chief doesn't need for the officers to write tickets into the other entity's courts. He would just like to have an agreement whereby they assist each other in their territories/jurisdictions.
21 O.S. 99a, A.2 provides that peace officers (including tribal officers) can "enforce the criminal laws of this state" . . . "[i]n response to a request for assistance pursuant to a mutual law enforcement assistance agreement with the agency of investigatory or territorial jurisdiction[.]"
I'm also curious as to who/which entities you think have to sign the agreement. We can enter into such an agreement under 74 O.S. 1221, D.1, which provides: "The governing board of a political subdivision of this state is authorized to negotiate and enter into intergovernmental cooperative agreements in behalf of the political subdivision, with a federally recognized Indian tribal government within this state to address issues of mutual interest. Except as otherwise provided by this subsection, such agreements shall be effective upon approval by the Joint Committee on State-Tribal Relations and the Governor, or the designee of the Governor." However, the CM has investigated and apparently the Joint Committee on State-Tribal Relations doesn't actually meet. Is it sufficient for a mutual-aid agreement to be signed by the chair of the Joint Committee and the Governor? Is there a simpler process? It looks like the standard BIA agreement is signed by the chair of that Joint Committee, the Governor, the AG - ugh.
