Good morning everyone.
We have a non profit Main Street program in Collinsville that is anchored by the Oklahoma Department of Commerce but is an independent 501 (c) and it has decided to transfer the program to the City. So far, the City has not agreed to take the program or assume responsibility for the operation of the program.
I am familiar with Burkhardt v City of Enid and Brown v City of Warr Acres and I do understand that there needs to be a public purpose for us to use funds for this organization but I am trying to determine if the organization needs to be dissolved first before we assume management of the program or if it is permissible for the city to continue operation of the non profit with our staff and resources to continue the public purpose, assuming a public purpose exists.
Maybe the auditor for the city would have an opinion on how we might deal with it but I am hoping to find someone or some city who has assumed operation of a Main Street program and find out how it was done.
