Dear Vuecrest property owners,

It has always been the practice of our community to handle compliance with Vuecrest governing documents and policies in a neighborly fashion. Unfortunately, some owners have chosen to ignore our Protective Restrictions of Vuecrest, which erodes our community over time. Blocking protected views, ignoring building requirements, and other violations of the Protective Restrictions impact us all, and diminishes the unique value and appeal of Vuecrest. And failing to consistently enforce the Protective Restrictions is unfair to owners who do comply with our Vuecrest Protective Restrictions.

Beyond our neighbor-to-neighbor and good neighbor programs, we needed another tool to help the Vuecrest Community Association enforce resolution of compliance issues.

In 2022 we had a town hall discussing a fine and enforcement topic to manage recurring issues we have had over the past few years. Since then, we have taken and incorporated feedback from the community and engaged with the Association's legal team to draft this fine enforcement policy.

In April 2024, the Board reviewed an updated draft. On May 2nd, 2024, the Vuecrest HOA legal team joined the monthly Vuecrest Community Association meeting to go over the entire policy and answer questions from the Board and the owners who were present. There were no changes necessary to the draft and allowed the policy to be voted on and approved during open session. The Fine and Enforcement Policy (attached) is scheduled to go into effect June 2, 2024.

This policy will formalize procedures to deal with violations of our Governing Documents (Protective Restrictions, Bylaws and Policies), which can be found on the Vuecrest Community Association website (vuecrest.net). RCW 64.38.020(11), RCW 64.38.025(1) and the General Provisions of the Protective Restrictions enable us to adopt this policy.

The Board would like to emphasize:

  1. This policy does not change how we approach and work to resolve issues in the Vuecrest Community. The Board still encourages neighbor-to-neighbor resolution first and foremost. If that does not resolve the issue, we have a good neighbor process that is mediated by the Good Neighbor committee.
    
  2. Only after those attempts have failed will the Board implement this policy,
    
  3. This policy does not change the approach, frequency, and philosophy for compliance reviews:
    

a.    The Board is traditionally reactive vs. proactive to compliance reviews.

b.    Most compliance reviews that come to the Board are triggered by owner complaints, a proposed external change to the property, redevelopment or a property ownership change or transfer.

c.      The Vuecrest Community Association is not planning on doing compliance reviews of properties.

d.    The Vuecrest Community Association will seek to educate owners on compliance issues, allow reasonable time for the issue to be resolved and follow-up as appropriate.
