IMLA Federal Funding Update

Good morning:

I have a few updates for you on funding issues.

  1. The Plaintiffs filed an amended complaint in King County v. Turner (attached) adding new plaintiffs and new grants to the complaint including grants administered by HUD and DOT including subagencies of DOT that imposed immigration and DEI conditions on grants like the FTA, FHWA, FAA, and FRA.

  2. Also in King County v. Turner, the court held a PI hearing yesterday and the following is noted on the docket: PRELIMINARY INJUNTCION HEARING held on 5/21/2025 via Zoom videoconference. Counsel present oral argument. In anticipation of issuing a written order granting Plaintiffs' Motion for Preliminary Injunction, and finding good cause therefor, the Court extends its May 7, 2025 Temporary Restraining Order by 14 days. Written order to follow."  I will keep an eye out for the written order.

  3. I am attaching the plaintiffs' motion for a PI in California v. Department of Transportation, which was filed yesterday.

  4. Grant cancelation.  A member received the following note from the federal government: "All Digital Equity Competitive and Digital Equity Capacity grant awards have been terminated, except for grants to Native Entities, which are pending further legal review."  The member would like to confirm that others received this as well and was wondering if any litigation is planned on this.  Let me know and I can connect you.

  5.
