Also, the parties in San Francisco v. Trump filed a second amended complaint last night, which seeks to add new plaintiffs, two new defendants, and new factual allegations. Here are a few of the relevant filings:
- Motion for Leave to File. This document has a helpful procedural timeline for the case and notes the complaint is adding new allegations related to factual developments since the first amended complaint which included additional executive orders, agency directives, and grant agreements. The amended complaint also adds OMB and Director Bought because of their inclusion in EO 14,287 ("Protecting American Communities from Criminal Aliens."). https://storage.courtlistener.com/recap/gov.uscourts.cand.444175/gov.uscourts.cand.444175.151.0.pdf
- Here is the Amended Complaint, which adds new plaintiffs and new factual allegations related to events that have occurred since the last amended complaint. For example, the complaint adds allegations regarding the Secretary Noem restrictions on FEMA funding from March 25, 2025 as well as allegations related to the DHS standard terms and conditions as well as other agency conditions the DOT Duffy Letter and agency directives and the HUD's CoC and CDBG grant conditions. These are all items that the parties have already brought before the court (for example, in the recent dispute over the application of the PI to the DHS standard terms and conditions / DOT Duffy Letter).
