As most of you are aware, the opening of the second gate onto Waterview Drive has caused much consternation with some individuals from the adjoining neighborhood.
Change from their previous way of life on a dead end street is hard to accept. While most of us are courteous and respectful as we exit, according to our neighbors, some are not. This has caused the continued antics to disrupt our lives.

At that time, Robert Brach, Director of Bexar County Development Service, supported the Fire Marshal’s position that the gate could only be used for “emergency access.”
Given this the Homeowners Association engaged legal counsel. At that point, the Fire Marshal advised the Association’s legal counsel that they should deal directly with the head of the Civil Division for the Bexar County District Attorney’s Office, Assistant DA Ed Schweninger. After much discussion between our legal counsel and the DA’s office, the DA’s office ultimately concluded that given language contained in the subdivision’s Plat that was filed in the Official Public Records of Bexar County, the Association had the right to utilize the gate onto Waterview Drive, a public roadway, for the purpose of egress from the Association.
The DA’s office communicated its conclusions to both the Fire Marshal and Sheriff’s Office. As a result, the Association has had the ability without obstruction from the Fire Marshal or Sheriff’s office to utilize the second gate onto Waterview Drive to exit the subdivision since early October.
Unfortunately, notwithstanding the DA’s office’s decision concerning this matter, and that they no longer have the support of the Fire Marshal, Bexar County Public Works or Sheriff’s office, some of the individuals from the adjoining neighborhood have taken matters “into their own hands.”
In particular, the Board has received reports that individuals are making derogatory gestures as our residents exit, shining lights in our resident’s eyes, and most recently numerous residents have reported nails in their tires. It is our hope that these childish antics will dissipate with the passage of time.
That said, however, we believe that our residents need to be proactive in dealing with these matters.
First and foremost, our concern is for your safety. Our recommendation is continue to take the high road and not directly engage with these few bad actors from the adjoining neighborhood. Nevertheless, members are encouraged to report all such instances to the Sheriff’s Office Non-Emergency Dispatch at 210.335.6000. This creates an official public record of the complaint and if the sheriff’s office is called enough times the hope is that they will issue citations to and/or arrest the disgruntled few. In addition, residents are encouraged to report any code violation issues on Waterview Drive (junk cars, debris, lines crossing roadway, etc.) to Bexar County. This can be done by visitingwww.bexar.org, navigating to Public Works and then selecting the “Report an Issue” tab. This will allow you to report non-emergency related code violation issues to the County. As always, in the event of an emergency requiring immediate assistance members should dial 911.

It just requires you to set up a profile so that you can go back in to see
if the issue is being addressed. I think it would be a good idea to get as
many complaints registered as possible. You can choose a category such as
broken down vehicles but also health and safety issues. That is what I
focused on but also included the junk and trash and the fact that there is
a mental health concern for the one particular individual. You will need
to pinpoint the address on the map. The address of the property with the
camper is 9142 Aqua Dr. Boerne. The address of the residence across the
street from which he runs his electricity and water is 27926 Waterview
Drive. Hope this helps.
