Quick Question. I have two (2) executive session items ... (1) the hiring, employment and contract terms of the City Manager, (2) the hiring, employment and contract terms of the City Attorney. Each item is listed separately on the agenda under executive session. However, the items are combined on the agenda item to vote to go into executive session for both matters.

That is not a problem so long as the minutes reflect that there was an executive session vote for each issue.

I would separate them just to be safe from open meetings act scrutiny.

Has your city adopted Robert's Rules of Order? If it has not, I believe that reading the two agenda items and noting that both are listed for executive session before the motion is made to go into executive session and the vote taken would be fine. If your City has adopted Robert's Rules of Order, then to be safe I would have whoever makes the motion to go into executive session state in that motion that the executive session is for both agenda items (1) and (2).

As long as the agenda is complete and accurate, there is not a problem holding one executive session to cover both. Be sure that the Executive Session minutes note who is present and who left for each part of the session. However, we do not have a "log - rolling prohibition", so a single vote to go into an executive session is fine.
