Good afternoon: Here are a few federal funding and immigration updates: 1. Funding. On Thursday, a 2-1 panel of the Fourth Circuit issued a stay of the permanent injunction and preliminary injunction pending appeal in Sustainability Institute v. Trump. The court found that the federal government was likely to succeed in showing that the district court lacked jurisdiction under the Tucker Act. The court found that the case was akin to Department of Education v. California and essentially just a case about enforcing a contractual obligation to pay money. I am attaching the decision. 1. Funding/Immigration. I am attaching the response to the plaintiff's PI motion in Illinois v. FEMA. 1. Funding / Immigration. I am attaching the memorandum of law in support of the plaintiffs' motion for a PI in Chelsea v. Trump, which was brought by Chelsea & Somerville, MA seeking to enjoin the federal government from withholding federal funds based on immigration policies. 1. Immigration. There was a letter filed by the plaintiff in United States v. Newark today. The docket is still sealed so I am working on retrieving this from contacts there and if it is substantive, I will pass it along. If anyone has already grabbed this and has a copy, please send it to me. 1. Immigration. A member of the group provided all the amicus briefs in the birthright citizenship case pending before the Fourth Circuit (Casa v. Trump). There is a brief filed by a coalition of local governments on p. 365. Also, as a reminder, since we aren't sure if a new sanctuary jurisdiction list will go up, please forward me any letters you receive from DHS related to the sanctuary issue so that I can share with the group if/when those go out. There is an immigration call on Wednesday at 2 pm eastern and a funding call on Thursday at 3 pm eastern.
