Code Enforcement Citations by Mail

All,

Currently, our code enforcement citations are issued in person only based on previous practices. They are wanting to shift to mailing citations like many cities do. Does anyone on the listserv have an example of an ordinance that allows this, and can I see some examples of fine schedules? Or any advice on how to implement this would be handy as well.

I am not familiar with issuing citations by mail ;however I question the authority for it and the  wisdom of it.  If the defendant does not respond to the mail then it would be dangerous to issue a warrant for non-appearance based on a mail out.  Just thinking out loud

We would issue a citation and the court would send a summons to the defendant advising them that a citation has been filed and the deadline for the defendant to appear.

We do that as well.  I would also suggest if you do it by certified mail, it be “restricted delivery, return receipt requested” to ensure it went to the actual defendant if you plan to issue a warrant for a failure to appear.
